Thread: DSR question

  1. #1

    Default DSR question

If I sell something online, but the customer comes and collects, but inspects the item before paying and taking away, is it covered by the distant selling regulations or is it treated as a face to face transaction?
I've looked at the DSR regulations, and this situation doesn't seem to be detailed in them.
    Anyone know?

I think this is the same as when you reserve on-line and collect, as with Argos, and to the best of my knowledge is no longer treated as a DSR sale. I may be wrong, but that's my interpretation.

I don't see the scenario as any different than a buyer going to a store to purchase in response to an advert. As such it would be governed by the Sale of Goods Act but not the Distance Selling Regulations.

The DSR cover sellers who are business sellers but not casual private sellers.

The DSR do not cover auction sales but do cover fixed priced listings on sites like eBid..

I f somebody comes to collect and can inspect the purchase before taking away, this situation would not be covered by the DSR because it is no longer a mail order purchase..

It is in your interest that a customer inspects goods before taking them away.
